Can a witness be forced to testify by a defence lawyer in a criminal case in Scotland?
Q. A witness to a supposed crime does not wish the hassle of appearing in court. But their evidence is critical to the defence. What are the options for the defence. Can a sworn statement be offered or can the witness be forced to attend court lawfully to corroborate what they have already stated openly in public to the accused. thanks for your answers . Scottish law is different in most ways from English law thats why its harder to find answers. seems unfair that the procurator fiscal can force a witness to testify in Scotland but the solicitor for the defence cannot. A. Statements are only admissible in very limited circumstances under Section 259 of the Criminal Procedure (Scotland) act 1995 - in effect, unless you are dead, compulsorily detained in a mental hospital or genuinely untraceable after efforts have been made, your statement, even if given in the form of an affidavit, is inadmissible, as it cannot be tested by cross-examination. If cited by the defence to attend for trial you must attend; if you do not do so then a warrant will be granted for your arrest, and the court may find you in contempt of court. In a summary case, the power to arrest an obstructive witness who has failed, without reasonable excuse to answer their citation is found in Section 156 of the Criminal Procedure (Scotland)… [cont.]

What would help secure a position in Officer training, Australian Defence Force?
Q. Im 14 when i turn 18 and have gone to college, i was hoping to enlist at ADFA (Australian Defence Force Academy). Is ADFA hard to get into? While young should i do anything to help secure myself a position? I am reasonably intelligent, quite a few high distinctions from the Uni of NSW, which i think would carry some weight, and i am reasonably fit, and in 4 years time i'm sure i could meet the requirements. Thanks alot!

A. Work experience is essential for any applicant. Not just the compulsory, brief work experience offered as part of high school programs - go out and look for a job, perhaps when you're 15 or 16. Maybe you attend the shopping trolleys at Safeway, or work at the counter at KFC - it'll give you life experience and make you a more desirable applicant. Play team sports - besides being good for your fitness, it's good for teamwork... obviously. It's pretty much expected that any given applicant at any level has played some. Any kind of junior leadership experience will go a long way, too - maybe you're the assistant manager at Subway, or you were a House Captain or captain of a sports team in high school. A. there are two ways really you can Zone defence which basically means that when your player gets the ball instead of marking the ball you mark the space so you might be able to intercept the next pass. then there is the normall man to man marking which you stick with your player at all times.
